LEGAL FEES INCLUDING COURT FEES

 

Written agreements are recommended for consulting and written opinions done by german attorneys. Such agreements shall serve to prevent disputes between lawyers and clients. Fees for representation before the courts as well as inter parties exchange of correspondence are regulated by the statute on payment for al services of attorneys unless negotiated otherwise. Subject to further pending legislation quota litis agreements between clients and attorneys are actually not enforceable.

If no agreement is concluded the attorney is entitled for the usual fee on the basis of the german civil code in cases of consultation services outside a pending litigation before the courts. Services in pending litigation are ruled by special statute and fixed by the court. 

Consumers are protected against unreasonable fees by a limitation of fees for a first introductory conversation with his client. This limit is an amount of EURO 190.00 and for a following consultation with a limit of EURO 250.00 plus value added tax.
